State law requiring kayak training

I thought I'd get things rolling in Hot Topics with a post about a Maine law that would have required kayakers get instruction in preforming a wet exit. You can read the story here. It doesn't go into great detail about how the law would actually have worked,  and it doesn't say if it passed or not.

I think the intent of the law was probably good, but I think paddling safety (and boater safety in general) needs to be looked at globally and not just piecemeal.

I also think this proposed law is part of a larger issue that we paddlers are going to have to face sooner or later: more state regulation of paddling in the form of boat registration, licensing, etc. Whether you like it or not, it's coming. The question is, is the paddling community going to be proactive in the process???

Read this yesterday and have spent considerable time pondering the situation.  I have always believed that when it comes to this type of legislation/regulation/government intervention, less is better.  You can mandate and legislate good sense about safety issues until you are blue but it is impossible to instantaneously make everybody safety conscious and smart.  If someone doesn't believe or know there is a serious risk or inherent danger, no amount regulation will change their actions.

IMHO, this tragic death was the result of negligence, ineptitude, or laziness (or any combination thereof) on the part of the instructor.  It seems the victim did the smart thing, he signed up for instruction.  Even if he was doing something wrong, he was an unknowledgeable newbie, that's why he was in the class.  The instructor should have been aware of what was happening.  Sadly, he got the wrong instructor.

To me, this is not a legislative/regulatory issue.  It is a judicial issue, but that's another topic for discussion.

My sincerest condolences to Mrs. Beauvais on the tragic loss of her husband.


Better to be up the creek without a paddle than to not be on the creek at all.

I agree with G P, it's a lawsuit.

I'm so fed up with the Gov'mt legislating my life I'm almost ready for a one man rebellion!

What makes it sooo bad is that the younger generation don't remember when we had more freedom because they never had it.

Our disgusting, scumbag politicians bleed us so slowly that we just take it, they are very careful not to take enough at once to wake us up.

  Hope we can play well together on this forum.

    There was a politican in Mass who's buddy got hit by a car while riding his bicycle. This pol wanted to pass a law for bicycles to ride AGAINST the traffic.  This guy was unencumbered by the thought process.  I guess he never heard of oneway streets, or flying down a hill at 40-50 miles per hour into oncoming traffic. I'm glad this guy was talked out of it.

Constantly accused of playing devil's advocate, I wonder about the potential positives to instruction. There is no laws about paddling and in my limited experience (remember my bio - I am a NEWBIE in all caps), I have seen some real idiots paddling - dangerous to themselves and therefore potentially dangerous to others. Not sure I am all for the legislation but also not opposed to well thought out regulation that might make the "masses" more safe. Legislation will not prevent some of the stupids (just think of laws and drunk driving) but it might help (just think laws about age of drivers). Again, this is a novice speaking who is also not unduly distressed by legislation. I would love a world where the occupants did the responsible thing and the smart thing and the "right" thing but.... just my 2 cents... opinions...
